Starting a business on unemployment in Pennsylvania

Under Section 402(h) you are ineligible for any week in which you are self-employed, and starting a new business counts from the 'first positive step' (advertising, renting an office, buying equipment). The only exception is a sideline business that you ran alongside your job and that passes a four-part test: it made less than your job, it has not substantially grown, and you stay available for full-time work. How self-employment affects your benefit
Under Section 402(h) you are ineligible for any week in which you are self-employed, and starting a new business counts from the 'first positive step' (advertising, renting an office, buying equipment). The only exception is a sideline business that you ran alongside your job and that passes a four-part test: it made less than your job, it has not substantially grown, and you stay available for full-time work.
Your partial benefit credit (PBC) is 30% of your weekly benefit rate: earnings are subtracted from weekly benefit rate + PBC and you are paid the difference, never more than your weekly benefit rate.

- Office of Vocational Rehabilitation (OVR), PA Department of Labor & Industry: can fund a self-employment plan if you have a disability.
- Medicaid: Pennsylvania expanded Medicaid, so the new work requirement applies to expansion adults: 80 hours or $580 net a month, and hours on your business count. Planned start: 1 January 2027.
