Ask the unemployment agency before you rely on it. ## How self-employment affects your benefit Under Section 402(h) you are ineligible for any week in which you are self-employed, and starting a new business counts from the 'first positive step' (advertising, renting an office, buying equipment). The only exception is a sideline business that you ran alongside your job and that passes a four-part test: it made less than your job, it has not substantially grown, and you stay available for full-time work. Register with PA CareerLink within 30 days of filing, and keep a record of all work search activity for two years.
